1. General
1.1. These terms apply to purchases in the online shop gaussworkshop.com.
1.2. If the buyer is a consumer — a natural person buying goods for purposes outside their trade or profession — the contract is a distance contract. It is governed by the Latvian Consumer Rights Protection Law, Cabinet of Ministers Regulation No. 255 of 20 May 2014 on distance contracts, and other laws of the Republic of Latvia.
1.3. By placing an order the buyer confirms that they have read these terms.
1.4. The version of the terms in force when the order was placed applies to that order. Later changes do not affect orders already placed.
2. Placing an order
2.1. The price and description are shown with each product.
2.2. Most products are made from the buyer’s artwork: it can be created in the design tool on the site or uploaded as a ready file. The tool shows the product and the price straight away.
2.3. To order, add the products to the cart, fill in the order fields, choose a delivery method and pay. The total including delivery is shown before payment.
2.4. After payment we send a confirmation with the contents of the order to the email address given. If it has not arrived, check your spam folder and write to us.
3. Prices
3.1. Prices are in euro and include value added tax at 21 %.
3.2. The delivery charge is added during checkout and is shown before payment.
3.3. If an obvious error makes a price substantially lower than the usual value of the product, the seller may decline to fulfil the order. We tell you immediately and refund the full amount paid.
4. Payment
4.1. The currency is the euro. Payments are processed by the licensed payment institution Maksekeskus AS (the MakeCommerce platform).
4.2. You can pay by bank link or by payment card (Visa, Mastercard). The list of banks is shown at checkout; it covers banks in Latvia, Estonia, Lithuania and Finland.
4.3. When paying by bank link, return to the shop after confirming the payment — press “Back to merchant” on the bank’s page. Otherwise the order may stay unconfirmed.
4.4. The personal data needed to make the payment is passed to Maksekeskus AS. We never see or store card details.
4.5. The contract is concluded when the payment is received.
5. The buyer’s artwork and responsibility for its content
5.1. By uploading an image, logo, text or other material, the buyer confirms that they have the right to use it for printing.
5.2. We do not produce material that infringes the rights of third parties, offends human dignity, incites violence or breaches the law. Such an order is cancelled and the amount paid is refunded.
5.3. The buyer is responsible for the content of the artwork — its text, spelling, size and placement. Before production we check the artwork only technically.
5.4. Colours on screen and in print may differ slightly: screens are calibrated differently, and ink on fabric, vinyl or banner material looks different from light on a display. A small difference in shade is not a defect. If the colour is critical, write to us before ordering.
5.5. If the resolution of the artwork is too low, the design tool warns about it. If the warning is ignored, we print what the file allows.
6. Production and delivery
6.1. We make the order within 3–5 working days of payment. Delivery time comes on top of the production time.
6.2. We deliver to Latvia, Estonia, Lithuania, Finland and Sweden. Orders can also be collected free of charge from our office in Riga.
6.3. Delivery methods, carriers and prices are described on the Delivery page.
6.4. If production is delayed, we tell you and agree a new date or refund the amount paid.
6.5. Once the parcel has been handed to the carrier, the delivery time is set by the carrier. A parcel waits in the parcel machine for the period set by the carrier; if it is not collected, the parcel comes back to us and sending it again is a paid service.
6.6. Check the packaging when you receive the parcel. If it is damaged, record this with the carrier and let us know — that way we can sort it out faster.
7. Goods made to order
7.1. Products created in the design tool or from the buyer’s artwork are made individually. The 14-day right of withdrawal does not apply to them — Cabinet of Ministers Regulation No. 255, point 22.3 (goods made to the consumer’s specifications or clearly personalised).
7.2. The right of withdrawal does apply to ready-made goods from the shop that are not made to order. See the Returns and refunds page.
7.3. Until we have started production, we can cancel an order at the buyer’s request and refund the amount paid. Write to us as soon as possible.
7.4. The right of withdrawal does not apply to legal persons.
8. Goods not conforming to the contract
8.1. We are liable for any lack of conformity that existed on the day of delivery and becomes apparent within two years (Consumer Rights Protection Law, Section 13(2)). If it becomes apparent within one year of delivery, it is presumed to have existed at delivery (Section 13(3)).
8.2. Send your claim to info@gaussworkshop.com with the order number, a description and, if possible, a photo.
8.3. We give a written reply to a claim within 15 working days of receiving it (Consumer Rights Protection Law, Section 26.¹(5)).
8.4. If the goods do not match the order or the print is faulty, we make them again or refund the money, including delivery. In that case we cover the cost of return.
9. If an order cannot be fulfilled
If an order cannot be fulfilled, we tell you and refund the amount paid as soon as possible, and no later than 14 days after the notice.
10. Force majeure
The seller is not liable for failure or delay in performance caused by circumstances beyond its reasonable control. We inform the buyer of such circumstances and agree what to do next.
11. Disputes
11.1. We settle disputes by negotiation first. Write to info@gaussworkshop.com.
11.2. If the outcome does not satisfy you, as a consumer you may turn to the Consumer Rights Protection Centre (ptac.gov.lv) and to the Consumer Dispute Resolution Commission.
11.3. Buyers from other EU countries can get help from the European Consumer Centre (ecclatvia.lv).
11.4. Disputes not settled out of court are heard by a court of the Republic of Latvia. Latvian law applies.
